一 | 법원 "대출받으려다 조직원에게 속았을 가능성" ⓒ 뉴스1 윤주희 디자이너(인천=뉴스1) 박소영 기자 = 보이스피싱 피해금 1170만 원을 자신의 계좌로 받은 뒤 일부를 엔화로 환전해 다른 현금수거책에게 전달한 혐의로 재판에 넘겨진 40대 남성이 국민참여재판에서 무죄를 선고받았다.인천지법 형사12부(신상렬 부장판사)는 전기통신금융사기 피해 방지 및 피해금 환급에 관한 특별법 위반 혐의로 기소된 A 씨(46)에게 무죄를 선고했다고 26일 밝혔다.A 씨는 지난해 5월 20일 보이스피싱 조직원과 공모해 피해자 B 씨로부터 1170만 원을 가로챈 혐의로 기소됐다.당시 보이스피싱 조직원은 금융기관 직원을 사칭해 B 씨에게 "기존 대출이 있는데 대환대출을 신청하는 것은 계약 위반이어서 기존 대출금을 상환해야 대출이 가능하다"고 속인 것으로 조사됐다.B씨는 이에 속아 A씨 명의의 은행 계좌로 1170만 원을 송금했다.A 씨는 이후 조직원의 지시에 따라 피해금 중 일부를 일본 엔화 100만 엔으로 환전한 뒤 서울 서초구의 한 지하철역 출구 앞에서 다른 현금수거책에게 전달했다.검찰은 A 씨가 보이스피싱 조직과 공모해 현금수거책 역할을 맡았다고 판단해 재판에 넘겼다.그러나 A 씨는 "대출을 받기 위해 외환 거래실적을 쌓아야 한다는 조직원의 말을 사실로 믿었을 뿐 보이스피싱 범행인 줄 몰랐다"며 혐의를 부인했다.A 씨의 희망에 따라 국민참여재판으로 진행된 재판에서 배심원 7명 가운데 4명은 무죄, 3명은 유죄로 판단했다.재판부도 배심원단의 다수 의견과 마찬가지로 A 씨가 보이스피싱 범행에 가담한다는 사실을 알고 있었다고 단정하기 어렵다고 판단했다.조사 결과 A 씨는 배우자의 수술비를 마련하기 위해 대출 광고 문자를 보고 보이스피싱 조직원에게 연락했던 것으로 파악됐다.조직원은 실제 금융기관의 대출상품을 언급하면서 허위 거래내역을 만드는 이른바 '작업대출'을 통해 대출을 받을 수 있는 것처럼 A 씨를 속였다.재판부는 A 씨가 조직원의 지시를 수상하게 여겼더라도 정상적인 절차가 아닌 '작업대출'을 위한 과정으로 오인했을 가능성이 있다고 봤다.또 A 씨가 자신의 계좌가 지급정지된 이후에도 상당 기간 조직원에게 계속 연락하면서 금융감독원 서류 제출 등 문제 해결을 요청한 점도 무죄 판단의 근거가 됐다.재판부는 "검사가 제출한 증거만으로는 피고인이 자신의 행위가 보이스피싱 조직원의 범행에 가담하는 것임을 미필적으로나마 인식하고 용인했다는 점이 합리적인 의심을 배제할 정도로 증명됐다고 보기 어렵다"고 밝혔다.。
